Appealing six litigations over trademark infringement before Guangdong High People’s Court, Louis Vuitton (LV) eventually settled with Guangdong hotel chain Gladden Hotel and a distributor Zhao Hong.
In 2007, the designer brand filed six cases to Dongguan Intermediate People’s Court for trademark infringement. The court held that, the infringing products use labels identical with LV’s registered trademarks. Infringement is constituted. For Zhao’s shop is within the hotel premises and no clear indictor to exclude its association with the hotel, the court then granted injunction and destruction of infringing products and awarded LV 600,000 yuan in damages.
The disgruntled Gladden appealed to the High Court. The presiding judge then facilitated the settlement.
