Guangdong High People’s Court recently ruled in favor of Siemens China and Siemens Energy and Automation Company, awarding an injunction and 150,000 yuan in damages from the defendant Shenzhen Co-Trust technology Co., Ltd.

In February 2008, the co-plaintiff lodged a complaint to Shenzhen Intermediate People’s Court on the ground of infringement of product copyright and the rights of name, packaging and art working of their well-known products by Shenzhen Co-trust.

Shenzhen Intermediate People’s Court sincerely examined and compared the products in question, found that Shenzhen Co-Trust’s products copied the co-plaintiff’s, and substantive similarity established. The court held the infringement constituted.

Shenzhen Co-trust appealed to the Guangdong High People’s Court after the first instance judgment. The court then entered the above-mentioned final judgment.
